We granted defendants application for an interlocutory appeal from an adverse ruling of the trial court on defendants motion to dismiss a criminal information charging him with battery on a peace officer, contrary to § 30-22-24, N.M.S.A. 1978. Defendants motion was based upon the theory of collateral estoppel. We reverse and remand to the trial court with directions to grant defendants motion and dismiss the criminal information.
